Terms and Condition

Welcome to www.rnbgbeauty.com (“RNBG” and/or “We” and/or “Us” shall be used interchangeably) provide website features and services to you when you visit RNBG’s website, use its services, that may extend to, but not limited mobile apps, or any other applications provided by RNBG in connection with any of the foregoing (collectively, “RNBG Platforms”).

Introduction

This Agreement governs your use of RNBG platforms and the services that you use and/or any purchases made thereunder. The Terms of Use stated herein constitute a legal agreement between you and RNB GLOBAL SDN BHD (1418232-H), having its registered office at, Unit 6, Level 4, The Corinthian, Jalan Binjai, 50450, Kuala Lumpur, Malaysia.

These Terms of Use apply to all users of the site, including without limitation users who are browsers, customers, RNBG members, merchants and/or contributors of content.

You must read, agree with and accept all of the terms and conditions contained in these Terms of Use. Please review carefully these terms and conditions, which govern your use of RNBG Platforms on which these terms and conditions appear. By accessing RNBG Platforms, registering for an account with us and/or using any of RNBG’s services and/or purchasing something on RNBG Platforms constitutes your unconditional agreement to be bound by these terms and conditions (hereinafter referred to as “Terms”). If you choose NOT to accept these terms and conditions or any of its revisions, please do not proceed and immediately exit, discontinue your access and/or use of RNBG Platforms.

We reserve the right, from time to time and without prior notice, revise and/or upgrade whether in whole or in part, RNBG Platforms and shall not be liable if any such revision and/or upgrades prevent you from accessing RNBG’s website or any part of RNBG Platforms. You acknowledge and agree that it is your sole responsibility to check these Terms of Use periodically for any updates. That said, your continued use of RNBG Platforms following the posting of any updates constitutes of your full acceptance of those changes.

Compliance with Legal Age Restrictions

You can browse RNBG Platforms without telling us who you are and/or revealing any personal information about yourself. Once you give us your personal information, you are not anonymous to us.

By agreeing to these Terms of Use, you represent that you are at least the age of Eighteen (18) as per Section 11 of the Contracts Act 1950, or if you located overseas, you are at least the age of majority in accordance to the applicable laws in your country.
If you are under 18 years of age, you may only use RNBG Platforms with the consent of and under the supervision of your parent or legal guardian who shall be responsible for all your activities.
You shall not access and/or utilize any RNBG Platforms for any illegal and/or unauthorized purpose and/or to violate any laws in your jurisdiction that include, but not limited to relevant copyright laws.

Usage of RNBG Platforms and Services

As a condition of your continued use of RNBG Services and/or access to RNBG Platforms, you agree that you shall use our Services in accordance with these Terms of Use and shall not: –

Post false, inaccurate, misleading, defamatory, or libellous content (including personal information) on third party sites;
Take any action that may undermine the feedback and/ or ratings systems on bad faith on third party sites;
Transfer your account to another party without RNBG’s consent;
Copy, modify, or distribute content from RNBG Platforms and RNBG’s copyrights and trademarks;
Harvest or otherwise collect information about users, including email addresses, without their consent;
Use existing user accounts or create new user accounts in order to circumvent and/or manipulate RNBG’s monitoring system and/or processes in a manner that is fraudulent to enjoy any of RNBG’s promotions and/or privileges; and Exploit and/or attempting to exploit any benefits provided on RNBG Platforms (including but not limited to discounts and/or coupons) by signing up for multiple accounts and/or procure any of RNBG’s services with no intention to complete the same;
Attempt to and/or engage in any activity or act that is intended to abuse, abuses or inappropriately manipulates any promotion, campaign and/or discount codes offered through RNBG Platforms. Such act and activities include but are not limited to: creating fake or duplicate accounts;
generating fake orders; buying and reselling your own inventory; and
Authorise or encourage anyone to do any of the foregoing.

Accordingly, you shall conduct yourself in accordance with good public order and morals, and shall refrain from:

Persistently raising complaints without any reasonable grounds or justification; and
Engaging in behaviour which violates public order or is destructive to generally accepted customs or norms.

Accuracy, Completeness and Timeliness of Information

We don’t sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve and personalise our services, content and advertising. If you don’t wish to receive marketing communications from us or participate in our ad-customisation programmes, simply indicate your preferences on our website and/or by following the directions provided with the communication and/or advertisement.

Usage of Personal Data

Any reliance on the material on RNBG Platforms is at your own risk.
RNBG Platforms may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of RNBG Platforms at any time, but we have no obligation to update the same. You agree that it is your responsibility to monitor changes to RNBG Platforms.

We shall have no liability whatsoever in the event we provide reference information and/or contents provided by a third party and/or links on RNBG Platforms for your convenience, and you agree to visit such third party sites at your own risk, if any. For avoidance of doubt, we are not responsible for examining and/or evaluating, and does not warrant the products of such business or individual or the content of their web sites. We do not assume any responsibility or guarantee or liability for the actions, goods, services and content of all these and any other third parties. You should carefully review their privacy statements and other conditions of use.

We have made reasonable efforts to post current and accurate information on RNBG Platforms. However, you agree and acknowledge that we assume no responsibility for any errors, omissions and/or inaccuracies whatsoever in the information provided on RNBG Platforms. Under no circumstances, will we be liable for any loss or damage caused by your reliance on information obtained through RNBG Platforms. It is your sole responsibility to evaluate the accuracy, completeness and/or usefulness of any information provided, and use of RNBG Platform is solely at your own risk.

Purchase and Order Specifications

You may purchase any Product by placing and completing the order form on RNBG Platforms and shall be responsible for ensuring the accuracy of your order and such order shall be deemed to be irrevocable and unconditional upon transmission through RNBG Platforms. RNBG shall be entitled to process such orders without further consent from you. Nevertheless, you may request to cancel or amend the order which RNBG shall endeavour (but not obliged) to give effect to on a commercially reasonable effort basis.

Refund and Replacement Policy

You may initiate the returns process by communicating with RNBG through RNBG Platforms. You may only apply for return of the purchased Product in the following circumstances:

upon receipt of item, the sealed Product has visible packaging damage;
the Product delivered to you is defective and/or damaged on delivery;
the Product delivered to you is materially different from the description provided in the listing of the Product on RNBG Platform;
the Product delivered to you does not match the agreed specification (e.g. different size and/or types) stipulated in your order; and
such other circumstances which may be determined by RNBG on a case-by-case basis.

Subject to the provisions hereunder, RNBG accepts returns within 21 days of receipt, only if their seal/ delivery packaging has not been opened or the products are damaged or wrong product. Please notify RNBG immediately and return the jar/ box in its original packaging. In such instances, RNBG will endeavour to send you another or perform a refund, if deemed necessary.

Patch Test

You are always encouraged to patch test each RNBG Product before you use them to avoid any potential allergic reaction. Alternately, you are advised to purchase RNBG trial packs to ascertain suitability.

Return/Refunds Conditions

For clarity, you agree and acknowledge that RNBG can only accept returns of Product that have not been tampered with, are sealed and remain in the original packaging and are kept in adequate conditions and temperature prior to the return. If all these conditions are met, please ship your Product back to RNBG using a registered courier service. Nonetheless, RNBG reserves the right to refuse any returned shipments if the Product has been used or tampered with.

Shipping Costs

You agree and acknowledge that you will be solely responsible for the shipping costs for returning your Product. Shipping costs are non-refundable.

Suspension and Termination

You agree and acknowledge that you may cancel, stop accessing and/ or deactivate your Account at any time on RNBG Platforms.

Notwithstanding, you agree that the measures set out in this provision shall apply where your conduct of use violate RNBG Terms of Use, and you agree this is without prejudice to RNBG’s other rights and remedies under these Terms of Use or in law. The measures include:

Suspend or terminate your Account and/or your access to RNBG Platforms at any time, for any breach of these Terms, our guidelines, any additional terms and conditions and policies;
Change, modify, suspend or discontinue, whether temporarily or permanently, the whole or any part of the Services at any time, for any reason, and without advance notice;
Suspend or terminate your Account and/or your access to RNBG’s Services at any time, in the event of any act, threats of, verbal and/or written abuse against any of RNBG third party Merchant, RNBG employees, representatives and/or officer;
Banning you from RNBG Platforms or use of the Service for a specified time period or permanently; and
Taking any other actions against you or any accounts that you may have registered with RNBG.

Site Contents

RNBG is the sole owner or lawful licensee of all the rights and interests on RNBG Platforms. All title, ownership and Intellectual Property Rights on our Sites shall remain with RNBG, our affiliates and/or licensors of RNBG Platforms, as the case may be. All rights not otherwise claimed under these Terms and Conditions and/or by RNBG are hereby reserved.

Trademarks

All of RNBG’s related icons and/or logos are registered trademarks and/or trademarks or service marks owned or licensed by RNBG and are protected under applicable copyright, trademark and other proprietary rights laws. You are strictly prohibited from undertaking any unauthorised copying, modification, use or publication of these marks.

Copyright and other intellectual property rights in the content of RNBG Platform, including, but not limited to, any marketing and promotional materials, brochures, advertisements, concepts, video footages, photographs belongs to RNBG or its licensors (who have expressly licensed content to RNBG). Privacy

We use your information only as described in our Privacy Policy. We view protection of users’ privacy as a very important community principle. We store and process your information on computers that are protected by physical as well as technological security devices. You can access and modify the information you provide us and choose not to receive certain communications by signing-in to your account. If you object to your Information being transferred or used in this way, please do not use our services.

No Warranty

You acknowledge and agree that RNBG’s Services are provided on an “as is” and “as available” basis, and that your use of or reliance upon RNBG Platforms and any of its products or services accessed or obtained thereby is at your sole risk and discretion.

RNBG does not represent or warrant but RNBG endeavours that: (a) the use of RNBG Platforms will be secure, timely, uninterrupted or error free or that they will be compatible or operate in combination with any other hardware, software, system or data; (b) RNBG Platforms will meet your requirements or expectations; (c) errors, bugs or defects in RNBG Platforms will be corrected; or (d) RNBG Platforms and its servers are free of viruses or other harmful components.

All conditions, representations and warranties, whether express, implied, statutory or otherwise, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, are hereby excluded and disclaimed to the fullest extent permitted under the law.

RNBG Platforms may be subject to limitations, delays, and other problems inherent in the use of the Internet and electronic communications (including problems inherent to the computer or electronic device you use). For avoidance of doubt, RNBG is not responsible for any delays, delivery failures, damages, or losses resulting from such problems.

No advice or information, whether oral or written, obtained by you from RNBG Platforms, its employees, or agents shall create any representation, warranty or guarantee on behalf of RNBG.

In addition, RNBG Platforms may promote, advertise or sponsor functions, events, offers, competitions or other activities which may be conducted online or offline and which may be conducted by third parties. These activities may be subjected to separate terms and conditions; your participation in such activities is solely at your discretion and risk. RNBG does not accept any responsibility in connection with your participation in activities conducted by any other party.

Limitation of Liability

YOU ACKNOWLEDGE AND AGREE THAT YOUR ONLY RIGHT WITH RESPECT TO ANY PROBLEMS OR DISSATISFACTION WITH RNBG PLATFORMS IS TO REQUEST FOR TERMINATION OF YOUR ACCOUNT AND/OR DISCONTINUE ANY USE OF RNBG’S SERVICES.

IN NO EVENT SHALL RNBG OR ITS SUBSIDIARIES, AFFILIATES, PARTNERS, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS OR USE OF OR INABILITY TO ACCESS OR USE RNBG PLATFORMS OR ARISING OUT OF OR IN CONNECTION WITH YOUR CONDUCT IN CONNECTION WITH THE USE OF RNBG PLATFORMS INCLUDING WITHOUT LIMITATION DEATH, BODILY INJURY, EMOTIONAL DISTRESS WHETHER OR NOT THE DAMAGES WERE FORESEEABLE AND WHETHER OR NOT RNBG WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, RNBG’S AGGREGATE LIABILITY TO YOU (WHETHER UNDER CONTRACT, TORT, STATUTE OR OTHERWISE) SHALL NOT EXCEED THE AMOUNT OF MONIES RECEIVED BY RNBG IN RESPECT OF THE SERVICES GIVING RISE TO SUCH CLAIMS OR, WHERE RELEVANT, SHALL NOT EXCEED THE AMOUNT OF RINGGIT MALAYSIA ONE THOUSAND ONLY. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Force Majeure

If by any reason of any event of force majeure, any of the parties to this Agreement is delayed in or prevented from or hampered in performing any of its obligations under this Agreement, then such delay or non-performance shall not be deemed to be a breach of this Agreement. In such an event, the obligations of RNBG so affected by the force majeure event shall be suspended during the period of such force majeure event.

For avoidance of doubt, a force majeure event shall include, but shall, not be limited to any cause beyond the any parties’ reasonable control, including, but not limited to, Movement Control Order (MCO) or other similar orders given by the government or local authorities, acts of God, acts or omission of any government or order, rules, acts or omission of transportation/ logistics companies, material shortages, and/or delays in transportation, and/or delays of its suppliers, manufacturers and/or subcontractors for like cause, and/or where the Goods is seized by the local customs authorities at the Designated site causing a delay to load, regulations or fire, storm, flood, earthquake, accident, acts of war, pandemic, rebellion, insurrection, riot, invasion, strikes, industrial disputes or lockouts, or anything regarded as being beyond the reasonable control of RNBG.

Good Faith Negotiation

You agree and acknowledge that, should any dispute arise during the term of this Agreement, the Parties will make a good faith, though non-binding effort to reconcile any difference or dispute before the filing of an action in the Courts of Malaysia.

Applicable Law and Jurisdiction

By visiting RNBG Platforms, you agree that the laws of Malaysia, without regard to principles of conflict of laws, shall govern this Terms of Use and any dispute of any sort that might arise between RNBG and you. The Courts of Malaysia shall have exclusive jurisdiction over any legal action or the proceedings against RNBG arising out of, with respect to, or in connection with any disputes over this Terms of Use and disputes between RNBG and you.

General Provision(s)

Severability

If any provision of these Terms and Conditions is found to be illegal, void or unenforceable under the law, these Terms and Conditions shall continue in force save that such provision shall be deemed severed with effect from the date of such decision or such earlier date as RNBG may decide or the parties may agree, as the case may be.

Waiver

You agree and acknowledge that RNBG’s failure to exercise and/or enforce any of its rights conferred upon it by these Terms and Conditions shall not be deemed to be a waiver of any such rights or operate so as to bar the exercise or enforcement thereof at any subsequent time or times.

Correction of errors.

Any typographical, clerical or other error or omission in any acceptance, invoice or other document(s) on our part, if applicable shall be subject to correction without any liability on our part.
